Artists, writers, innovators, and entrepreneurs...in fact creative and business people from all backgrounds; mostly those starting out, but even some with a level of experience in their field behind them, have at some point or another realized they've had misconceptions about what copyright is, how it works, for what types of creative work, and what it can do for them. So, let's get started, and perhaps with the most obvious questions anyone may have about copyright; what is it, and why does it exist in the first place?Let's start with the latter question first. Why copyright exists Imagine this scenario; you build a cottage, say, to your own design. It's a beautiful, Tudor-style, thatched roof affair, with a small, well-kept garden, and a breath-taking view of rolling, verdant green hills offering spectacular sunsets in the evening. Now imagine someone finds out about your unique, very attractive cottage one day, and moves in while you're out. How do patents and copyrights encourage innovation
Many countries around the world are supporting the notion of free trade and globalisation, which is easy access to goods and services determined by market forces on a global platform with minimal government intervention (Hill, C., 2004). Some benefits of free trade would include higher consumption of goods and services; better utilization of resources; greater economic growth and higher creation of wealth (Hill, 2004).However, there exists strong opposition to globalisation and to the organizations promoting a freer world trade. Such opposition can come in the form of certain government intervention. There are several reasons for such opposition. First, certain jobs and industries need to be protected from foreign competition (Hill, 2004). United States gave protection to important industries such as automobile, machine tools and steel in the form of Voluntary Export Restraints (VER) in the 1980s, which protected jobs as well (Hill, 2004). However, such a move is not justified as the … [Read more...] about Globalisation and Free World Trade – Is it Justified?
EVERY schoolyard has a bully who uses his size to intimidate the other kids, or a rich brat who threatens to take his ball home if he doesn't get his way. This month, Microsoft played both roles by claiming in a Fortune magazine article that open source programs violated 235 of its patents.Microsoft claimed there were 42 such violations in the free Linux operating system, 65 in the way windows and menus look, 45 in OpenOffice, 15 in various e-mail programs and 68 more in other open source applications. To address these alleged breaches, Microsoft wants to start collecting royalties from open source developers and users, a move that would jack up the cost of free software."We live in a world where we honor... intellectual property," Fortune quotes Microsoft CEO Steve Ballmer as saying. Users of free and open source software are going to have to "play by the same rules as the rest of the business," he says. "What's fair is fair."But how fair are software patents?Originally, states granted … [Read more...] about Patently Wrong

PATENT PROTECTION FOR SOFTWARE IN INDIAINTRODUCTIONPatentability of the software- related inventions are very controversial in these days. In early 1960s and 1970s uniform response was that software was not patentable subject matter. But in subsequent years United States and Japan expanded the scope of patent protection. But several countries including Europe and India are reluctant to grant patents for computer program for the fear that technological progress in this volatile industry will be impeded. Proponents for the software patenting argue that patent protection will encourage, and would have encouraged, more innovation in the software industry. Opponents maintain that software patenting will stifle innovation, because the characteristics of software are basically different from those of the innovations of old Industrial, e.g. mechanical and civil engineering.PROTECTION FOR SOFTWARE -RELATED INNOVATIONSWIPO defined the term computer program as: "A set of instructions capable, … [Read more...] about Patent Protection For Software In India
